IMPORTANT: These Terms govern use of the HirelyUp platform by all users. By creating an account or using the platform, you agree to be bound by all parts of this document. If you do not agree, do not use HirelyUp.

This document is a starting template for informational purposes only. It does not constitute legal advice. Consult a licensed attorney in your jurisdiction before publishing.


PART 1 — CLIENT TERMS AND CONDITIONS

For businesses and individuals hiring talent on HirelyUp

1. Introduction and Acceptance

These Client Terms and Conditions (“Client Terms”) govern your access to and use of HirelyUp as a client seeking to hire freelance talent. HirelyUp LLC (“HirelyUp”, “we”, “us”, or “our”) is a Wyoming limited liability company operating a digital freelance marketplace accessible at hirelyup.com.

By registering as a client, posting a job, or engaging any freelancer through HirelyUp, you confirm that you are at least 18 years old, have the legal authority to enter into binding contracts on behalf of yourself or your organization, and agree to these Client Terms in full.

2. Platform Description and Limitations

2.1 What HirelyUp Provides. HirelyUp is an online marketplace enabling clients to post job listings, review freelancer proposals, communicate via in-app messaging, and process payments through a secure escrow system powered by Stripe Connect. HirelyUp acts as an intermediary and is not a party to contracts formed between clients and freelancers.

2.2 No Guarantee of Results. HirelyUp does not guarantee the quality, accuracy, timeliness, or legal compliance of work delivered by freelancers. Freelancers are not employees or agents of HirelyUp. You engage freelancers entirely at your own discretion, subject to the protections of our escrow system.

2.3 Platform Availability. HirelyUp strives to maintain 99.5% uptime but does not guarantee uninterrupted service. Scheduled maintenance, security updates, or circumstances beyond our control may temporarily affect platform availability. HirelyUp will provide advance notice of scheduled downtime wherever reasonably possible.

3. Client Account

3.1 Registration Requirements. To use HirelyUp as a client you must provide your legal name or business name, a valid email address, verified payment information, and accurate business information. You are solely responsible for all activity conducted through your account.

3.2 Account Verification and KYC. HirelyUp may require identity or business verification at any time, including Know Your Customer (KYC) checks conducted by our payment processor Stripe. Failure to complete verification may result in restricted access to platform features or funds held in escrow.

3.3 Account Security. You must maintain the confidentiality of your account credentials and immediately notify HirelyUp at security@hirelyup.com of any unauthorized use of your account or any other security breach. HirelyUp will not be liable for any loss or damage arising from your failure to protect your account credentials.

4. Posting Jobs

4.1 Accuracy Requirements. Job postings must accurately describe the scope of work, required skills, expected deliverables, timeline, budget, and any special requirements. Misleading or fraudulent postings will be removed without notice.

4.2 Prohibited Job Types. The following are not permitted on HirelyUp:

  • Requests for illegal, harmful, or unethical services of any kind
  • Services designed to circumvent tax obligations or regulatory requirements
  • Adult content, hate speech, or content targeting protected characteristics
  • Reproduction of copyrighted work without proper authorization
  • Test or fake postings without genuine intent to hire
  • Any posting violating applicable federal, state, or local law

4.3 Job Boost and Featured Listings. Clients may pay to feature job listings at the top of search results. Boosted listings are clearly marked as featured. Fees for boosted listings are non-refundable once the boost period has commenced.

5. Hiring, Contracts, and Worker Classification

5.1 Freelancer Selection. All hiring agreements must be established through HirelyUp’s platform tools. Circumventing the platform to hire a freelancer discovered on HirelyUp outside the platform is a material violation of these Terms and may result in account suspension and liability for outstanding service fees.

5.2 Independent Contractor Status. Freelancers are independent contractors, not employees of you or HirelyUp. You are solely responsible for ensuring proper worker classification under applicable law, including the IRS common law test, California AB5, New York Freelance Isn’t Free Act, and any other applicable state or federal worker classification standards. HirelyUp expressly disclaims any liability for worker misclassification.

5.3 Non-Circumvention. If you wish to hire a freelancer directly outside the HirelyUp platform, you must first obtain written consent from HirelyUp and may be required to pay a platform introduction fee. This restriction applies for 24 months from your first contact with the freelancer through HirelyUp.

6. Payments, Fees, and Escrow

6.1 Escrow System. All payments are processed through Stripe Connect escrow. When you engage a freelancer, funds must be deposited into escrow before work begins. Funds are held securely and released only upon your approval of completed work. Escrowed funds are protected and cannot be accessed by HirelyUp except in accordance with dispute resolution procedures.

6.2 Service Fee Structure. HirelyUp charges clients a service fee on each completed transaction:

  • Starter (no subscription): 8% on projects up to $2,500 | 6% on $2,501–$10,000 | 4% on $10,001–$50,000 | 3% above $50,000
  • Pro Plan ($49/month): 5% flat rate on all project sizes plus featured listing credits
  • Business Plan ($149/month): 3% flat rate plus dedicated support, team seats, and custom contract templates

HirelyUp reserves the right to modify fee rates with 30 days written notice. Fees applicable at the time of project funding apply to that project regardless of subsequent fee changes.

6.3 FTC Fee Transparency. In compliance with FTC regulations effective May 2025, all applicable fees are disclosed as line items before any payment is processed. HirelyUp will never add undisclosed charges to any transaction. Your total payment obligation is displayed at checkout before you confirm any transaction.

6.4 Payment Processing and Third-Party Fees. Payments are processed by Stripe. By using HirelyUp, you agree to Stripe’s Terms of Service and Privacy Policy available at stripe.com/legal. Stripe’s transaction processing fees (typically 2.9% + $0.30 per card transaction or lower for ACH bank transfers) are included in the total charged to your payment method and displayed separately at checkout.

6.5 Refunds and Dispute Resolution. If a freelancer fails to deliver agreed work, you may raise a dispute through HirelyUp’s resolution center within 14 days of the missed deadline or unsatisfactory delivery. HirelyUp will review evidence from both parties within 5 business days and make a binding determination. If resolved in your favor, escrowed funds will be returned within 5 to 10 business days. HirelyUp’s dispute resolution decisions are final and binding.

6.6 No Off-Platform Payments. All payments for work arranged through HirelyUp must be processed through the platform. Off-platform payment requests are a red flag for fraud. HirelyUp will never ask you to pay via wire transfer, cryptocurrency, gift cards, or any method outside the platform. Report any such requests immediately to security@hirelyup.com.

7. Communication and Video Interviews

HirelyUp provides built-in messaging (powered by Stream Chat). All platform communications are subject to monitoring for safety and policy compliance. You may not use these tools to solicit freelancers off-platform, share personal contact information before a hiring agreement is executed, or engage in harassment or threatening behavior.

8. Intellectual Property

8.1 Work Product Ownership. Unless otherwise agreed in writing, all original work product created by a freelancer for your specific project and fully paid through HirelyUp escrow constitutes a work made for hire, with all intellectual property rights transferring to you upon full payment and escrow release.

8.2 Pre-Existing IP and Third-Party Licenses. Freelancers retain ownership of any pre-existing tools, frameworks, or code libraries they use. If a freelancer’s deliverables incorporate third-party licensed materials, the freelancer must disclose this in writing before contract execution. You are responsible for any additional licensing fees required for your intended use.

9. Prohibited Conduct

As a client, you agree not to:

  • Post false, misleading, or fraudulent job listings or company information
  • Discriminate against freelancers based on any protected characteristic
  • Solicit or engage freelancers discovered through HirelyUp outside the platform within 24 months
  • Use the platform for money laundering, fraud, or any illegal purpose
  • Harass, threaten, stalk, or defame any freelancer
  • Scrape, reverse-engineer, or copy HirelyUp’s platform, algorithms, or data
  • Attempt to gain unauthorized access to any HirelyUp system or another user’s account

10. Limitation of Liability

To the maximum extent permitted by law, HirelyUp’s aggregate liability for any claim arising from these Terms shall not exceed the total service fees paid by you in the twelve months preceding the claim. HirelyUp shall not be liable for indirect, incidental, special, consequential, or punitive damages including lost profits or data.

11. Indemnification

You agree to indemnify, defend, and hold harmless HirelyUp LLC, its officers, directors, employees, agents, and successors from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your use of the platform, your breach of these Terms, your violation of any law, or your infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Wyoming, USA, without regard to conflict of law principles. You and HirelyUp agree to first attempt to resolve any dispute through good-faith negotiation for 30 days. If unresolved, disputes shall be submitted to binding arbitration under the American Arbitration Association Commercial Arbitration Rules. Class action lawsuits are expressly waived.

13. Modifications and Termination

HirelyUp may modify these Terms at any time with 30 days notice via email and in-platform notification. Continued use after the effective date constitutes acceptance. HirelyUp may suspend or terminate your account for material breach of these Terms, fraudulent activity, or conduct that endangers other users or the integrity of the platform.

PART 2 — FREELANCER TERMS AND CONDITIONS

Enhanced protections for freelancers — inspired by global best practices

1. Introduction and Our Commitment

These Freelancer Terms govern your use of HirelyUp as a service provider. HirelyUp was founded on a single principle: freelancers deserve to keep every dollar they earn. We have built our entire business model around this commitment. This document governs the relationship between you and HirelyUp, and gives you clear, enforceable rights as a member of our community.

2. The Zero-Fee Commitment — Legally Binding

HirelyUp charges freelancers ZERO platform fees on their earnings, now and permanently. This is not a promotional period or introductory offer. It is a binding commitment embedded in these Terms.

ZERO-FEE GUARANTEE: HirelyUp will never deduct any platform service fee, commission, or transaction percentage from earnings paid to freelancers. You keep 100% of every dollar clients pay for your work. This commitment may only be changed with a minimum of 90 days advance written notice, and any change will apply prospectively only — it will never affect contracts already in progress.

The only deductions from your earnings will be:

  • Payment processor fees charged directly by Stripe (typically 0% to 1.5% depending on your withdrawal method and country — this is Stripe’s fee, not HirelyUp’s)
  • Any applicable withholding taxes required by law in your jurisdiction (handled by Stripe, not HirelyUp)

3. Freelancer Account and Profile

3.1 Registration. You must provide accurate information including your legal name, email address, skills and experience, portfolio samples, hourly or project rates, location and timezone, and a professional profile photo. All information must be truthful and current.

3.2 Identity Verification (KYC). To receive payments, you must complete identity verification through our KYC process powered by Stripe Identity. This includes government-issued photo ID, a selfie for liveness verification, and bank account or payment method verification. This process is required by financial regulations and protects you from payment fraud.

Your KYC information is processed and stored by Stripe in accordance with Stripe’s Privacy Policy. HirelyUp does not store raw copies of your identity documents — we only receive a verification status (verified or not verified) from Stripe.

3.3 Tax Information. US-based freelancers earning $600 or more per calendar year must provide a completed IRS Form W-9. Non-US freelancers must complete IRS Form W-8BEN. You are solely responsible for your own tax obligations. HirelyUp provides annual 1099-K forms to qualifying US freelancers as required by IRS regulations. HirelyUp does not withhold taxes on your behalf.

3.4 Founding Freelancer Status. The first 100 freelancers who join HirelyUp and complete identity verification receive permanent Founding Freelancer status, including a featured profile placement, a Founding Member verified badge visible to all clients, and priority access to every job posting. This status is non-transferable and lasts for the lifetime of your account in good standing.

3.5 Profile Ownership. Your profile, portfolio, ratings, and work history on HirelyUp belong to you. You may export your complete HirelyUp profile data at any time from your account settings. Upon account deletion, HirelyUp will provide you with a full data export within 30 days.

4. Proposals and Applications

4.1 Free and Unlimited Proposals. Submitting proposals on HirelyUp is completely free, with no credits, connects, or tokens required. You may submit proposals to any job posting at any time at no cost. This is a fundamental difference from competing platforms.

4.2 Proposal Standards. Proposals must be original and specifically address the job posting. Generic or copy-pasted proposals that do not reference the client’s specific requirements may be flagged and may result in reduced visibility. AI-assisted writing is permitted in proposals, but the proposal must be reviewed and personalized by you.

4.3 Communication in Proposals. You may not include personal contact information (personal email, phone, WhatsApp, Skype, LinkedIn, etc.) in proposals before a formal hiring agreement is executed. This protects your earnings by ensuring all work remains under escrow protection. You may include your personal website or portfolio URL.

5. Performing Work — Your Rights and Obligations

5.1 Your Right to Decline. You retain the absolute right to decline any job offer, cancel any proposal, or withdraw from any negotiation at any time before a formal contract is executed and escrow is funded. Once escrow is funded and work has commenced, withdrawal may be subject to partial payment obligations as outlined in the contract terms.

5.2 Right to Set Your Own Rates. HirelyUp will never suggest, recommend, or pressure you to lower your rates. Your hourly rate or project pricing is yours to set and change at any time. HirelyUp’s fee structure is designed so that your take-home pay equals exactly what the client agrees to pay you.

5.3 Milestone-Based Projects. For fixed-price projects, work is structured into milestones. Each milestone is defined before work begins with clear deliverables, deadlines, and payment amounts. You submit completed milestones through the platform for client review. The client has 7 days to approve, request revisions, or raise a dispute. If no action is taken within 7 days, the milestone is automatically approved and payment is released.

5.4 Automatic Payment Release. If a client fails to review and respond to a submitted milestone within 7 calendar days, HirelyUp will automatically release the escrowed funds to your account. You will never be left waiting indefinitely for payment on delivered work.

5.5 Hourly Projects. For hourly contracts, you must log hours accurately through HirelyUp’s time tracking tools or by mutual written agreement with the client. Clients have 5 days to dispute logged hours after the weekly billing cycle closes. Undisputed hours are automatically paid at the end of each billing week.

5.6 Communication Standards. You are expected to maintain professional communication, respond to client messages within 24 hours on business days, and proactively inform clients of any delays before deadlines occur. Consistent non-responsiveness is grounds for account review.

5.7 Protection Against Scope Creep. Once a milestone’s scope is agreed and escrow is funded, clients cannot unilaterally expand the scope of work without funding additional escrow for the additional work. If a client requests work beyond the agreed scope, you have the right to submit a change order through the platform before performing additional work.

6. Payments — Your Rights Are Protected

6.1 Zero Fees — Reaffirmed. As stated in Section 2, HirelyUp charges you nothing. You receive 100% of what clients pay into escrow for your work.

6.2 Escrow Protection. All client payments are held in escrow via Stripe Connect before you begin work. This means you are guaranteed payment for work delivered — clients cannot withhold payment for work that meets the agreed specifications. Escrow funds cannot be returned to the client without either your agreement or a ruling from HirelyUp’s dispute resolution process.

6.3 Payment Release Timeline. Payments are released to your Stripe-connected account within 3 to 5 business days of client approval. For automatically released payments (7-day auto-approval), funds are released within 3 to 5 business days of the auto-approval date. HirelyUp will notify you by email at each stage of the payment process.

6.4 Minimum Payout Threshold. There is no minimum payout threshold on HirelyUp. You may withdraw any available balance at any time, regardless of amount. We believe your money is your money.

6.5 Withdrawal Methods. You may withdraw earnings to:

  • US or international bank account via ACH or SWIFT wire transfer through Stripe (typically 1–3 business days, low or no fee)
  • Wise Business account — direct bank-to-bank transfer at mid-market exchange rates
  • Stripe-supported debit card — instant withdrawal to eligible cards

6.6 Currency and International Payments. HirelyUp supports USD as its primary currency. Clients pay in USD. If you receive payment into a Wise or multi-currency account, you can hold, convert, or withdraw in your local currency at competitive mid-market rates. HirelyUp does not impose currency conversion fees, any FX fees are those of your chosen payment provider.

6.7 Your Tax Responsibilities. You are an independent contractor and solely responsible for all taxes on your HirelyUp income, including income tax, self-employment tax, national insurance contributions, VAT, GST, or any other applicable taxes in your jurisdiction. Consult a local tax professional. HirelyUp provides IRS 1099-K forms to qualifying US freelancers. Non-US freelancers must complete Form W-8BEN to certify their non-US tax status.

7. Dispute Resolution — Freelancer Protections

7.1 Your Right to Raise a Dispute. If a client refuses to approve completed work that meets the agreed specifications, fails to fund escrow before demanding work, requests work beyond the agreed scope without additional payment, or engages in abusive, fraudulent, or harassing behavior, you have the right to raise a formal dispute through HirelyUp’s resolution center.

7.2 Dispute Process. Upon filing a dispute, escrowed funds are frozen. Both parties submit evidence within 3 business days. HirelyUp’s resolution team reviews all evidence and makes a determination within 5 business days. The determination is binding. If resolved in your favor, funds are released to you within 3 to 5 business days. HirelyUp’s decision is final but may be appealed within 10 days on grounds of procedural error or new material evidence.

7.3 Protection Against Fraudulent Clients. HirelyUp actively monitors for patterns of fraudulent client behavior including fake job postings, refusal to fund escrow before requesting work, and repeated disputes filed in bad faith against freelancers. Clients found to be acting in bad faith will have their accounts suspended and may be permanently banned from the platform. Freelancers who suffer harm from fraudulent clients may be eligible for compensation from HirelyUp’s Freelancer Protection Fund (launched upon platform reaching 1,000 active users).

8. Independent Contractor Status and Protections

You are an independent contractor. This means you have freedom in how, when, and where you work. You may work for multiple clients simultaneously, on or off HirelyUp. HirelyUp will never restrict your ability to work on other platforms or for other clients.

However, as an independent contractor, you are not entitled to employment benefits from HirelyUp or clients including health insurance, paid vacation, workers’ compensation, unemployment insurance, or employer tax contributions. You are responsible for your own professional liability insurance, equipment, and workspace.

8.1 Right to Refuse Work. You may decline any job offer, cancel any proposal, or refuse any work request that makes you uncomfortable, regardless of reason, at any time before a contract is executed. After contract execution and escrow funding, withdrawal is still permitted but may result in a partial refund to the client for unfunded milestones.

8.2 Anti-Discrimination Protection. HirelyUp prohibits clients from discriminating against freelancers based on race, color, religion, gender, gender identity, sexual orientation, national origin, disability, age, or any other protected characteristic. Any client found to be discriminating will have their account terminated. Freelancers who experience discrimination may report it to legal@hirelyup.com.

9. Ratings, Reviews, and Reputation

9.1 Transparent Review System. After each completed project, both you and the client may leave a rating (1–5 stars) and a written review. Reviews are double-blind — neither party sees the other’s review until both have been submitted or 14 days have passed. This prevents coercion or retaliatory reviews.

9.2 Review Accuracy. Reviews must be honest, factual, and based on the actual working experience. Reviews that contain false statements, personal attacks unrelated to work quality, or that violate HirelyUp’s content standards will be removed following investigation. HirelyUp will investigate review removal requests but cannot remove legitimate negative reviews solely because you disagree with the feedback.

9.3 Protection Against Review Manipulation. Clients who threaten to leave negative reviews as leverage to extract additional work or refunds are engaging in extortion and will have their accounts suspended. Report any such threats immediately to security@hirelyup.com. Reviews left after documented extortion attempts will be removed and the client account investigated.

9.4 Your Reputation is Portable. Your HirelyUp ratings, review text, and work history are yours. You may export your complete review history at any time. If you close your account, you will receive a full export of all your reviews and ratings within 30 days.

10. Intellectual Property — Freelancer Rights

10.1 Work Product. Unless you and your client agree otherwise in a written contract before work begins, work product created specifically for a client and fully paid through escrow constitutes a work made for hire, with intellectual property transferring to the client upon full payment. This is the default — you may negotiate different terms with clients.

10.2 Your Pre-Existing Tools and IP. Any code libraries, templates, frameworks, design systems, or other materials you created before the client engagement remain entirely your property. You retain the right to use these in future client work. You must disclose any pre-existing IP incorporated into deliverables before contract execution so the client can make an informed decision about licensing.

10.3 Portfolio Rights. Unless a client explicitly requests a written confidentiality agreement before contract execution, you retain the right to display completed work in your HirelyUp portfolio and professional portfolio as evidence of your skills and experience. The client may request portfolio removal within 60 days of project completion, and you must comply within 14 days.

10.4 AI-Generated Content Disclosure. If you use AI tools to generate any part of a deliverable, you must disclose this to the client in writing before submitting the work. Passing off AI-generated content as entirely human-created original work without disclosure constitutes misrepresentation and is grounds for contract cancellation without payment.

11. Confidentiality

By accepting a client engagement, you implicitly agree to maintain the confidentiality of any non-public business information the client shares with you in the course of the project. Unless a separate NDA is executed, this confidentiality obligation covers information clearly marked as confidential or that a reasonable person would understand to be confidential. This obligation survives termination of your HirelyUp account.

12. Account Suspension and Termination

12.1 Grounds for Suspension. HirelyUp may suspend your account for: material breach of these Terms, repeated substantiated complaints from clients, fraudulent activity, identity misrepresentation, or account inactivity exceeding 18 months.

12.2 Your Rights Before Termination. Before permanently terminating your account, HirelyUp will provide you with written notice and a 14-day opportunity to respond and cure any curable breach. Emergency suspension for fraud or security threats may occur immediately but will be followed by written notice and an opportunity to appeal within 10 business days.

12.3 Effect of Termination. Upon account termination, any escrowed funds for active contracts will be handled through dispute resolution. Any earned funds already released to your connected payment account are entirely yours and unaffected. HirelyUp will provide a data export of your profile, reviews, and earnings history within 30 days.

13. Non-Solicitation

Clients who discover you through HirelyUp may not engage your services for work of the same type outside the platform within 24 months of your first contact through HirelyUp without HirelyUp’s written consent. This provision protects the marketplace that enables your access to global clients.

14. Limitation of Liability

HirelyUp’s liability to you for any claim shall not exceed the total earnings processed through your account in the three months preceding the claim. HirelyUp is not liable for client non-payment beyond escrowed funds, loss of business opportunity, reputational damage caused by client reviews, or indirect or consequential damages.

15. Governing Law and Dispute Resolution

These Terms are governed by Wyoming law, USA. Disputes are resolved first through good-faith negotiation, then binding arbitration under AAA rules. You waive the right to class action participation against HirelyUp.

PART 3 — COPYRIGHT NOTICE

Intellectual property rights covering the HirelyUp platform

1. Copyright Ownership

The HirelyUp platform, including its website, applications, software, source code, designs, interfaces, graphics, logos, icons, text, written content, data compilations, and all other materials (the “Platform Content”) is the exclusive property of HirelyUp LLC and is protected by United States copyright law, international copyright treaties, and other applicable intellectual property laws.

2. Trademark Rights

The HirelyUp name, rocket logo, tagline “Work Beyond Limits,” and all associated brand elements are trademarks or service marks of HirelyUp LLC. Unauthorized use of HirelyUp trademarks in connection with any product or service not affiliated with HirelyUp is prohibited.

3. Limited License to Users

HirelyUp grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform Content solely for your use of HirelyUp’s services. This license does not include any right to resell, copy, republish, distribute, or create derivative works from Platform Content.

4. User-Generated Content

4.1 Your Ownership. You retain ownership of all intellectual property rights in content you post on HirelyUp including job descriptions, proposals, portfolio items, messages, and reviews.

4.2 License You Grant HirelyUp. By submitting content to HirelyUp, you grant HirelyUp a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your User Content solely in connection with providing and promoting the HirelyUp service. This license does NOT include the right to use your content to train AI models without your separate, explicit, opt-in consent.

4.3 Content Representations. By submitting content, you confirm you own or have rights to it, it does not infringe third-party IP rights, and it complies with HirelyUp’s content standards.

5. DMCA Policy — Copyright Infringement Reporting

5.1 How to Report Infringement. If you believe your copyrighted work has been infringed on HirelyUp, send a DMCA notice to legal@hirelyup.com including:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Description of the copyrighted work claimed to be infringed
  • Location of the allegedly infringing material on HirelyUp with sufficient detail for us to locate it
  • Your contact information including name, address, phone, and email
  • A good-faith belief statement that the use is not authorized by the copyright owner
  • A sworn statement that the notice information is accurate and you are authorized to act on behalf of the copyright owner

5.2 Counter-Notification. If you believe removed content was removed in error, you may send a counter-notification to legal@hirelyup.com with the required statutory information. We will restore content within 10 to 14 business days unless the copyright owner files a court action.

5.3 Repeat Infringer Policy. HirelyUp terminates the accounts of users who are determined to be repeat copyright infringers, consistent with Section 512(i) of the DMCA.

6. AI Training Data — Explicit Protection

HirelyUp expressly prohibits use of any user’s content, work product, communications, or profile data to train artificial intelligence or machine learning models without that user’s separate, explicit, affirmative opt-in consent. This prohibition applies to:

  • All freelancer work product uploaded to or transmitted through HirelyUp
  • All client job descriptions, briefs, and project requirements
  • All platform messages and communications between users
  • All profile data, portfolio items, and user-generated content

Unlike some competing platforms that default users into AI training programs, HirelyUp defaults to AI training OPT-OUT. You will never be enrolled in an AI training program without affirmatively choosing to participate.

7. Enforcement

HirelyUp reserves the right to pursue all available legal remedies for copyright violations including injunctive relief, actual damages, statutory damages up to $150,000 per willful infringement, and attorneys’ fees. Copyright violations may also result in immediate account termination and referral to appropriate authorities.
